Refund policy

Sales of products online on commercial sites are classified as "distance contracts" and are regulated by the Consumer Code (Legislative Decree 206/2005 as amended by Legislative Decree 21/2014) in articles. 51-67.

Pursuant to the Consumer Code (Legislative Decree 206/2005) as amended by Legislative Decree. 21/2014, the Customer who signs a distance contract has the right to withdraw from the purchase contract for any reason, without the need to provide explanations.

The right of withdrawal provided for by art. 49 paragraph 4 of Legislative Decree 206/2005 can be exercised by the Customer within 14 (fourteen) days of receipt of the purchased goods.

The Customer who intends to exercise the right of withdrawal must communicate to “SHOPIFY - ITALIAN STILETTO” his desire to exercise this right.

The right of withdrawal can be exercised exclusively by the customer-consumer, that is, the natural person who purchases the goods for purposes not related to his professional activity and who therefore does not indicate a VAT number reference in the order form, pursuant to the combined provisions of the articles 3 and 52 Consumer Code Legislative Decree 206/2005 as amended.

Therefore, it is specified that customers who purchase with a VAT number cannot exercise the right of withdrawal. The withdrawal cannot be exercised in the event of lack of the original packaging, all the elements accompanying the product and anything else present in the original packaging. It is not possible to exercise the withdrawal only on part of the purchased product.

Withdrawal method

Within 14 days from the date of delivery of the goods the consumer must send a communication by REGISTERED MAIL. 

Having received the registered letter from Nce Srl relating to the communication of withdrawal from the purchase contract, the company's Customer Service will contact the consumer by telephone or e-mail to accept the request, if the conditions are met and confirm the possible shipment of the package.

The right of withdrawal is based on the substantial integrity of the goods received.

The goods must therefore be carefully packaged by the Customer to avoid damage during shipping. The original packaging must be used and the product must be complete with everything originally contained. We recommend insured shipping via express courier.

The Customer-Consumer who exercises the right of withdrawal is required pursuant to art. 57 Consumer Code, to return the goods to “SHOPIFY - ITALIAN STILETTO ” at his own expense and without undue delay, and in any case within 14 days from the date on which he communicated to the Seller his intention to withdraw from the contract; the Customer is responsible for the product during shipping. In the event of loss, theft, or otherwise, “SHOPIFY - ITALIAN STILETTO ” reserves the right to charge for any damage suffered.

Within 14 days of acceptance of the withdrawal by “SHOPIFY - ITALIAN STILETTO ” the customer must send the product via courier.

Upon arrival of the goods “SHOPIFY - ITALIAN STILETTO ” will verify the integrity of the goods and the presence of all products accompanying the original product, in order to evaluate the existence of all the conditions for the correct exercise of the right of withdrawal.

The company will refund all payments received from the consumer, possibly including delivery costs, without undue delay and in any case within 14 days from the day on which it received the products subject to the withdrawal request.

The company will carry out the refund using the same payment method used by the consumer for the initial transaction, unless the consumer has expressly agreed otherwise and provided that he does not incur any costs as a consequence of the refund.

The consumer is solely responsible for the decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.

To establish the nature, characteristics and functioning of the goods the consumer should only handle and inspect them in the same way as he would be allowed to do so in a shop.

Consequently, during the withdrawal period the consumer should handle and inspect the goods with due diligence (art. 57 Consumer Code Legislative Decree 206/2005).

In the event of damage to the product during transport, “SHOPIFY - ITALIAN STILETTO” will notify the Customer of what has happened (within five working days of receiving the product in its warehouses), to allow the customer to immediately file a complaint against the courier he has chosen and obtain reimbursement of the value of the product (if insured by the customer).
